1. Agreement and operator
These Terms are a binding agreement between you and QREATE's individual operator established in the Netherlands (“QREATE”, “we”, “us”). They apply to qreate.cloud, the dashboard, Discord bot, verification pages, AI Crew, support and related services (the “Service”). By using the Service or adding the bot to a server, you agree to these Terms and the Privacy Policy. If you act for an organisation or Discord server, you confirm that you can bind it. Contact:

2. Eligibility and consumer rights
You must meet Discord's applicable minimum age and have legal capacity to agree. If local law requires parental consent, you may use the Service only with that consent. You must maintain a valid Discord account and comply with Discord's terms and policies.
Nothing in these Terms excludes mandatory consumer, privacy or other rights that cannot lawfully be waived. If you are an EU consumer, mandatory protections and the courts available under applicable consumer law remain available to you.
3. The Service and beta status
QREATE provides configurable Discord community-management features, including moderation, verification, roles, tickets, logging, automation, publishing, engagement, analytics and AI-assisted guidance. The Service is in active beta. Features, limits and integrations may change, and some functions depend on Discord or other providers. Unless a separate written service-level agreement says otherwise, we do not guarantee uninterrupted availability, preservation of content, or any particular result.
4. Accounts, authority and security
Dashboard sign-in uses Discord OAuth; QREATE does not receive your Discord password. You are responsible for your Discord account, authorised users, credentials, server permissions and activity under your access. Notify

Only connect or configure a server if you have authority to do so. QREATE may request broad Discord permissions because enabled modules perform administrative actions. Discord role hierarchy still applies. Review settings, previews and permissions before publishing or enabling automation.
5. Guild administrator obligations
A guild administrator controls which modules run and is responsible for its server rules, configuration, notices, legal basis, retention choices, moderator access, webhook destinations and content. You must inform members about relevant processing and honour their rights. You must not instruct QREATE to process data unlawfully or collect unnecessary sensitive data.
Where QREATE processes member data solely on your documented instructions, you are controller and QREATE is processor. Before production use requiring an Article 28 data-processing agreement, contact us; these public Terms alone are not represented as a complete bespoke DPA.
QREATE's AI assistant operates under an authority level that the server owner sets. By default it prepares changes and waits for a person to approve each one. Raising that level, or enabling the ability to delete, instructs QREATE to carry out actions on your server on your behalf, in some cases without a separate approval for each action. That is a choice you make for your server, and you accept responsibility for what the assistant does within the level you have set, including where its output is inaccurate or where it acts on an instruction it has misunderstood. Only the server owner can raise the level; anyone with dashboard access to the server can lower it.
Deleting a channel or a role on Discord is permanent. Discord provides no way to restore either, and QREATE cannot recover the messages, attachments, pins or identifiers involved. Before any deletion QREATE shows you the affected object as it exists on your server and requires your confirmation. Nothing in the Service reverses a deletion, and you should not rely on the ability to undo one.
6. Your content and instructions
You retain rights in content and configurations you submit. You grant QREATE a worldwide, non-exclusive, royalty-free licence to host, reproduce, transform, transmit and display them only as needed to operate, secure and improve the Service and fulfil your instructions. You represent that you have the necessary rights and lawful basis.
QAssets files are stored in Cloudflare R2 and served from stable public URLs under assets.qreate.cloud so they can appear in Discord and other integrations. Treat an uploaded asset as public to anyone with its URL. Archiving does not remove it; use permanent deletion to request removal from QREATE storage. You remain responsible for the file, its legality, rights and intended audience, and understand that cached or third-party copies may remain after deletion.
Do not submit secrets, payment-card data, special-category personal data, illegal material, or content whose processing is unnecessary. You are responsible for reviewing AI output, automations and scheduled actions before relying on them. AI output may be inaccurate and is not legal, medical, financial or professional advice.
The assistant can make mistakes. It can misread an instruction, act on the wrong object, or state something about your server that is not correct. Review what it proposes before you approve it, and review what it has done where it acts under an authority level you have raised. QREATE records the changes the assistant applies so you can see and, where technically possible, reverse them.
7. Acceptable use
You must not use the Service to break law or Discord rules; harass, exploit, discriminate against or endanger people; facilitate spam, malware, fraud, sexual exploitation or illegal content; infringe privacy or intellectual-property rights; scrape or profile people without a lawful basis; evade rate limits, verification, safety or access controls; probe or access systems without permission; reverse engineer except where that right cannot lawfully be restricted; overload the Service; or resell/access-share the Service without written permission.
You also must not use QREATE to make solely automated decisions with legal or similarly significant effects about individuals.
8. Enforcement and cooperation
We may investigate suspected misuse, preserve relevant evidence, limit features, remove content, suspend a user or guild, or terminate access when reasonably necessary to protect users, QREATE, providers or the public, comply with law, or enforce these Terms. Where practicable and safe, we will consider notice and an opportunity to remedy. We may cooperate with Discord and competent authorities in response to valid requests.
9. Third-party services
The Service depends on Discord and may integrate Cloudflare, IPQualityScore, DeepSeek, Anthropic, YouTube, Twitch, X and guild-selected webhooks. Their terms and availability apply independently. QREATE is not responsible for their outages, policy or API changes, account actions, or content, but this does not limit QREATE's responsibility where applicable law makes us responsible for our selection or use of a processor.
10. QREATE intellectual property
QREATE and its software, branding, designs and documentation are owned by or licensed to the operator. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable right to use the hosted Service for its intended purpose. No source-code, trademark or other ownership right is transferred. Feedback may be used without restriction or payment, provided we do not identify you publicly without permission.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and do not promise that the Service, AI output, moderation outcome, backups or integrations will be uninterrupted, accurate, secure or error-free. These disclaimers do not exclude warranties or remedies that applicable consumer law makes mandatory.
This applies in particular to the AI assistant, which can make mistakes, and to actions it takes under an authority level you have raised. We do not warrant that its output is correct or that an action it takes matches what you intended.
12. Limitation of liability
To the maximum extent permitted by applicable law, QREATE is not liable for indirect or consequential loss, lost profit, revenue, goodwill, opportunity or data arising from use of the Service. For a free Service, QREATE's aggregate liability arising from the Service is limited to EUR 100; for a paid Service, it is limited to the greater of EUR 100 or the fees you paid QREATE for the affected Service during the 12 months before the event.
The limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory data-protection obligations, or any liability that cannot lawfully be excluded or limited. Nothing here shifts liability to you for conduct for which QREATE is legally responsible.
13. Business-user indemnity
If you use the Service for a business or organisation, you will indemnify QREATE against third-party claims, losses and reasonable costs caused by your unlawful content, configuration, instructions, material breach of these Terms, or infringement of another person's rights. This clause does not apply to consumers to the extent prohibited by law and does not cover loss caused by QREATE's own breach, negligence or wilful misconduct.
14. Termination and data
You may stop using the Service, sign out and remove the bot at any time. Removing the bot stops future bot activity but does not by itself guarantee immediate deletion of stored records. Submit deletion requests under the Privacy Policy.
We may discontinue the Service or terminate access for material breach, security risk, legal requirement or provider dependency. Where reasonably practicable, we will give notice. Clauses that by nature should survive—such as ownership, accrued payment obligations, disclaimers, liability limits and dispute provisions—survive termination.
15. Changes
We may change the Service and these Terms. We will post the new version and effective date and use reasonable advance notice for material changes where practicable. Changes do not retroactively remove accrued rights. If a material change requires renewed agreement under applicable law, we will request it; mere continued use is not substituted for consent where consent is legally required.
16. Law and disputes
Dutch law governs these Terms, excluding conflict-of-law rules, but this choice does not deprive an EU consumer of mandatory protections of the country where they habitually reside. Contact

For business users, courts in the Netherlands have exclusive jurisdiction. Consumers may bring proceedings in any court available under mandatory law; QREATE will not rely on this clause to remove that right.
17. General terms and contact
If a provision is unenforceable, it is limited or removed only as necessary and the rest remains effective. A failure to enforce is not a waiver. You may not assign this agreement without consent; QREATE may assign it as part of a genuine business transfer, subject to applicable law and notice where required. These Terms and the Privacy Policy are the entire agreement for the general Service, except for a signed DPA, order form or SLA.
